These terms govern the use of Commun, the school information system operated by Commun EdTech Sdn. Bhd. (Registration No. 202401014736 (1560586-U)), by schools and by the staff, parents and students those schools invite onto it.

“Commun”, “we” and “us” mean Commun EdTech Sdn. Bhd., a company incorporated in Malaysia. “School” means the educational institution that has entered into a subscription with Commun. “User” means any person the School authorises to access Commun, including its staff, teachers, parents, guardians and students. By using Commun, a User agrees to these terms; a School agrees to them, together with its subscription agreement, on behalf of its Users.
Commun provides the School with access to a hosted software service for the administration of the School, including student records, admissions, attendance, academic records, timetabling, billing, e-Invoicing, communication and the related portals and mobile applications. The modules available to a School are those set out in its subscription. Commun may improve, add to or retire features over time and will give reasonable notice of any change that materially reduces a subscribed capability.
Access is granted by the School. Each User is responsible for the security of the credentials and one-time codes issued to them and for all activity under their account. A User must not share an account, attempt to access records they have not been authorised to see, or interfere with the service, its security or other Users. The School may suspend or remove a User’s access at any time; Commun may do so where it reasonably believes these terms have been breached or the service is at risk.
All information the School and its Users enter into Commun remains the property of the School. The School determines who may see and change it. Commun processes that information only to provide the service, to support the School, to maintain security and to meet its legal obligations, and in accordance with our Privacy Policy and Personal Data Protection Notice. Commun does not sell the School’s data and does not use it to advertise to Users.
The School is responsible for the accuracy of the information it enters, for holding the consents and giving the notices the law requires for the personal data it processes through Commun, for the conduct of its Users, and for any submission made in its name to third-party systems such as the Inland Revenue Board’s MyInvois platform or a payment gateway. Commun provides the tools; the School remains the party responsible for its statutory filings and its accounts.
Fees, billing periods and payment terms are set out in the School’s subscription agreement. Fees are stated in Malaysian Ringgit and are exclusive of any applicable taxes unless stated otherwise. Commun may suspend access where fees remain unpaid after written notice, and will restore it promptly once the account is settled.
Commun is designed to be available at all times and is monitored continuously. We schedule maintenance outside Malaysian school hours wherever possible and give advance notice of planned downtime. Support is provided to the School’s designated administrators through the channels stated in the subscription agreement.
Commun, its software, design, documentation and trade marks are owned by Commun EdTech Sdn. Bhd. or its licensors. The School and its Users receive a limited, non-exclusive, non-transferable right to use the service for the School’s own purposes during the subscription. Nothing in these terms transfers any intellectual property in the service to the School or a User.
Users must not use Commun to store or send material that is unlawful, defamatory, abusive or infringing; to send unsolicited messages; to introduce malicious code; or to attempt to reverse engineer, scrape or resell the service. Communications tools within Commun, including WhatsApp and e-mail channels, must be used in accordance with the applicable channel provider’s rules and with the recipient’s consent where required.
A School may end its subscription in accordance with its subscription agreement. On termination the School may export its data during the retention period stated in our Privacy Policy, after which Commun will delete it from active systems. Provisions of these terms that by their nature should survive termination, including those on data, intellectual property and liability, will do so.
Commun will provide the service with reasonable skill and care. To the extent permitted by law, Commun is not liable for indirect or consequential loss, for loss arising from information entered by the School or its Users, for the acts or omissions of third-party services the School chooses to connect, or for interruptions beyond Commun’s reasonable control. Commun’s total liability to a School in any subscription year is limited to the fees paid by that School for that year. Nothing in these terms limits liability that cannot be limited by law.
We may update these terms from time to time. The current version is always published at this address with its effective date. Where a change materially affects the School, we will notify its administrators before the change takes effect. Continued use of Commun after that date is acceptance of the updated terms.
These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising from them.
